Terms

This agreement is between Christopher Fisher Photography LLC ("Photographer") and the Client ("Client"). This contract is for services and products related to Photography, Videography, and 3D Virtual Tour products selected by the Client for the property being photographed ("Property"), at the date and time scheduled by the Client.

Christopher Fisher Photography LLC agrees to provide the Client with Photos in JPG format and Videos (if ordered) in MP4 format, which can be downloaded from the internet. The number of photos may vary depending on the condition of the Property or hindrances outside the control of Christopher Fisher Photography LLC that impede the allotted time while Christopher Fisher Photography LLC is at the Property.

Photos are to include the front and rear exterior views of the Property, as well as the living room, dining room, bedrooms, bathrooms, laundry room, and other areas as deemed appropriate by the Photographer. Photos will be professionally edited to ensure proper exposure, contrast, sharpening, and other similar adjustments. Custom editing such as the removal of items, replacement of skies, object removal, or other advanced editing services are not included under the terms of this contract but may be purchased for an additional cost.

The Client will have the opportunity to view low-resolution images prior to payment in full. Upon full payment, the Client will be able to download all high-resolution images of the Property, up to the number of photos included in the photography package selected by the Client.

In consideration of the Client's payment to Christopher Fisher Photography LLC for creating, preparing, and delivering the Photographs and/or Videos, Christopher Fisher Photography LLC grants the Client a limited license to use the Photographs and/or Videos in Stellar MLS compilations of properties (current and sold) and in real estate-related advertising, business cards, brochures, and other promotional materials, including the right to reproduce, create derivative works from, distribute, and publicly display the Photographs and/or Videos in print, on the Internet, and otherwise solely for the purpose of marketing the Property photographed under this Agreement.

In accordance with current copyright laws, including but not limited to the United States Copyright Act, 17 U.S.C. Section 106, Christopher Fisher Photography LLC is the owner of all Photographs and Videos produced under this Agreement and hereby retains full copyright to all Photographs and Videos. The Client is permitted to use the Photographs and Videos for the life of the real estate listing associated with the Property and for promotion of that listing only. The Client may not sell, redistribute, gift, transfer, provide, send, or upload the Photographs or Videos to any third party without the express written permission of Christopher Fisher Photography LLC.

Due to the nature of digital photography and videography, Christopher Fisher Photography LLC maintains a strict NO REFUNDS POLICY. The Client shall remain responsible for payment of the full contract price, including any outstanding balance, upon completion and delivery of the contracted services.

The Client acknowledges and agrees that photography and videography are artistic and creative services involving professional judgment regarding, among other things, composition, camera angles, framing, lighting, editing, color correction, shot selection, sequencing, and overall presentation. Dissatisfaction with artistic choices, including but not limited to photographic angles, composition, framing, shot selection, editing style, or creative approach, shall not constitute grounds for a refund, cancellation of payment obligations, withholding of payment, or any reduction of the amount owed under this Agreement.

If the Client has specific requirements regarding photographic or video angles, compositions, subjects, shot lists, editing preferences, or other creative elements, such requirements must be communicated in writing to Christopher Fisher Photography LLC prior to the scheduled photoshoot date and time. Christopher Fisher Photography LLC will make reasonable efforts to accommodate such requests but does not guarantee any particular image, angle, composition, or creative result.
